Terms of Service

Your account

• You must be at least 18 years old and able to form a binding contract.
• Give us accurate information and keep your email address current. We sign you in through links sent to that email, so keep your email account secure.
• You are responsible for everything that happens under your account. Tell us right away at support@weagora.app if you think someone else has accessed it.

Free trial, subscription and billing

• New accounts get a 30-day free trial. No payment card is needed to start.
• After the trial, keeping your page visible requires a paid subscription, currently $5 per month or $50 per year, plus any applicable taxes. If you don't subscribe, your page is hidden from visitors until you do.
• Subscriptions renew automatically each month until you cancel. Payments are processed by Stripe, and by subscribing you authorize recurring charges to your payment method.
• You can cancel any time from the Billing page. Your page stays active until the end of the period you've already paid for. Payments are non-refundable, including for partial months, except where the law requires otherwise.
• If a payment fails, your page may be hidden until payment succeeds.
• We may change prices with at least 30 days' notice by email. A price change takes effect at your next billing period after the notice.

Your content

• You own the content you put on your page, such as text, photos, logos and links.
• You give WeAgora a worldwide, non-exclusive, royalty-free license to host, store, copy, display, translate (if you turn on automatic translation) and distribute your content only as needed to run and improve the Service, including showing your page publicly and generating its QR code and share image. This license ends when you delete the content or your account, except for copies kept in backups for a limited time or required by law.
• You are responsible for your content and confirm that you have the rights to use it, and that it is accurate and lawful.
• We may feature public pages as examples on our website. If you'd rather we didn't feature yours, email us and we'll stop.

Acceptable use

You agree not to use the Service to:

• Break any law, or promote illegal goods or services.
• Impersonate another person or business, or use a name, logo or trademark you don't have the right to use.
• Collect payments, personal information or login details through deception, or link to phishing, malware or scam sites.
• Publish content that is hateful, harassing, sexually explicit, violent or defamatory, or that infringes someone else's rights.
• Send spam, or interfere with, overload, probe or bypass the security of the Service.
• Access the Service by automated means other than normal web browsing, or resell the Service without our permission.

Page addresses and QR codes

Your page address is assigned when you register and is locked so printed QR codes keep working. We may change or reclaim an address that violates these Terms, infringes someone's trademark, or would confuse visitors. Addresses of deleted accounts are retired and not given to anyone else.

Payments between you and your customers

Payment buttons on your page link to outside services such as Venmo, Cash App, Zelle and PayPal. WeAgora is not a party to those payments, doesn't process or guarantee them, and isn't responsible for disputes, refunds, chargebacks or fees between you and your customers. Those services' own terms apply.

Outside services and links

Pages can link to websites, apps and services that WeAgora doesn't control. We aren't responsible for their content, availability or practices.

Suspension and termination

You can stop using the Service at any time, and you can ask us to delete your account by emailing support@weagora.app. We may hide or remove content, or suspend or close an account, if we reasonably believe it violates these Terms, creates risk for others, or is required by law. Where reasonable, we will tell you why. Sections that by their nature should survive termination, such as ownership, disclaimers, limits of liability and disputes, will survive.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, WeAgora disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, that your page will bring you customers, or that information other users publish is accurate.

Limitation of liability

To the fullest extent the law allows, WeAgora will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not fully apply to you.

Indemnification

You agree to defend and hold WeAgora harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your dealings with your customers, or your violation of these Terms or of anyone's rights.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, and you and WeAgora consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally.

Changes to these Terms

We may update these Terms. If a change is material, we will notify account holders by email or in the dashboard before it takes effect. Continuing to use the Service after the change takes effect means you accept the updated Terms.

General

These Terms and our Privacy Policy are the entire agreement between you and WeAgora about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
